Terms and Conditions

Before Repo is a service operated by Optima Towing. These Terms and Conditions govern your use of the website, the intake form, the CRM messaging channels and any service provided by Before Repo. By requesting service, providing information or signing the Vehicle Surrender Authorization Agreement, you agree to these Terms.

Scope of Service

Before Repo provides towing, roadside assistance, vehicle transportation, pickup coordination, documentation support and voluntary vehicle return assistance.

Before Repo does not provide legal advice, financial advice, credit repair, debt settlement, loan modification or lender representation.

Before Repo acts as a service provider for logistics and documentation only. Any decision by your lender, finance company, credit reporting agency or any third party is outside Before Repo's control.

No Credit Guarantee

Before Repo does not guarantee credit protection, debt cancellation, loan forgiveness, lender approval or removal of negative credit reporting.

A voluntary vehicle return may still affect your credit. You may still owe a remaining balance, deficiency balance, fees or other amounts to your lender after the vehicle is returned or sold.

No Debt Cancellation

Before Repo does not cancel, settle or modify any loan or balance owed to your lender. Payment to Before Repo is for towing, transportation, coordination, documentation and return assistance services only. Payment to Before Repo does not reduce or satisfy any amount owed to your lender.

No Lender Approval Guarantee

Before Repo does not guarantee that the lender will accept the vehicle return, that the lender will treat the return in any particular way or that the lender will respond on any specific timeline.

You are responsible for confirming voluntary return instructions directly with your lender. We may assist with logistics and documentation, but the lender controls how the return is processed on their side.

No Credit Counseling

Before Repo does not provide credit counseling. Before Repo is not a credit counseling agency. We do not advise customers about credit scores, credit reporting, credit history or how lenders evaluate credit applications.

No Credit Repair

Before Repo does not provide credit repair. Before Repo is not a credit repair organization. We do not represent that any service we provide will improve, restore or change a customer's credit profile in any way.

No Debt Settlement

Before Repo does not provide debt settlement. Before Repo does not settle, reduce, renegotiate or otherwise modify any debt owed to a lender, finance company, collection agency or other third party.

No Loan Modification or Loan Negotiation

Before Repo does not modify loan terms. Before Repo does not negotiate with lenders on the customer's behalf. The customer must communicate directly with the lender regarding any payment arrangement, extension, deferment or modification.

No Insurance Advice

Before Repo does not provide insurance advice, claim advice or coverage advice. The customer must confirm all insurance matters directly with the insurance company or a qualified insurance professional.

No Legal or Financial Advice

Before Repo does not provide legal advice or financial advice. The customer should consult a qualified attorney, accountant or financial advisor for any legal or financial question.

Customer Responsibility to Confirm with Third Parties

The customer is responsible for confirming all financial, credit, legal and insurance matters with the appropriate lender, insurance company or qualified professional. Information collected and stored by Before Repo is for operational coordination only and does not substitute for direct communication with the customer's lender, insurer or qualified advisor.

Service Refusal for Incomplete or Risky Cases

Before Repo may decline or stop service if authorization, vehicle access, keys, insurance disclosure, accident disclosure, lender instructions or compliance review are incomplete, unclear or risky. Decisions about whether a case can be scheduled, picked up or delivered are operational and may change based on the information available at each stage.

Customer Authorization

You confirm that you are the owner, borrower, authorized possessor or otherwise legally authorized person to request assistance for the vehicle. Misrepresentation of authority is grounds for immediate cancellation of service and may result in legal liability.

Service for any case classified as Vehicle Rescue, Vehicle Return Assistance or Surrender Assistance can be scheduled only after the Vehicle Surrender Authorization Agreement has been reviewed and signed.

Payment Terms

Service fees must be paid before pickup unless otherwise approved in writing. Pricing is confirmed before any work begins.

Standard pricing: Basic Vehicle Return Assistance starts at $300, Priority Vehicle Rescue starts at $450, Emergency Rescue starts at $650 and is quoted per case.

Emergency Rescue, after-hours service, long distance towing, difficult pickups, restricted access locations and special handling may cost more. Any additional fees will be confirmed before they are charged.

Refund Policy

Service fees are non-refundable once dispatch has been confirmed or once any portion of the service has been performed. If service is canceled by you before dispatch, a partial refund may be issued at our discretion, less any administrative or coordination costs already incurred.

If service is canceled by Before Repo before dispatch, you will receive a full refund of any service fee paid for that case.

Chargebacks and Disputes

Initiating a chargeback for service that has been delivered is a violation of these Terms and may result in collection efforts, recovery of related fees and reporting to applicable parties.

If you believe a charge is incorrect, please contact us first so we can review and resolve the issue.

Vehicle Access

You confirm that the vehicle will be accessible at the pickup location and that you have the authority to grant access. Additional fees may apply if the vehicle is not accessible, not drivable, missing keys, located in a restricted or impounded area, blocked, outside the agreed service area or requires special handling.

Personal Belongings

You are responsible for removing all personal belongings from the vehicle before pickup or before final delivery.

Before Repo is not responsible for personal property left inside the vehicle. The Priority and Emergency packages include a personal belongings checklist that we walk through together at pickup time when feasible.

Photos and Documentation

You authorize Before Repo to take photos and record the condition of the vehicle, keys, mileage, exterior, interior and delivery location for documentation purposes.

These photos and records may be stored in our CRM and used for service documentation, customer confirmation, dispute response, payment verification or legal protection.

License Plate Handling

License plates should not be removed before the vehicle reaches the approved delivery location or Before Repo's designated delivery address.

If the vehicle is being delivered to Before Repo's address or another designated location, plates may be removed only at the delivery location, not before pickup and not during transportation, unless legally required or specifically instructed by the lender or applicable law.

License plate handling depends on state law, lender instructions and the specific return process. You agree to follow all applicable state requirements regarding license plates, registration cancellation, insurance cancellation and RMV or DMV procedures.

Customer Responsibility

You confirm that all information you provide is true and accurate. You agree to notify us immediately if any information changes before pickup or delivery. Inaccurate information may delay or prevent service.

Limitation of Liability

To the maximum extent permitted by law, Before Repo's total liability for any claim arising out of or related to the service is limited to the amount you paid for that specific service.

Before Repo is not liable for indirect, incidental, special, consequential or punitive damages, including loss of credit standing, deficiency balances, lender decisions, third party actions, lost income or related claims.

Service Cancellation

Before Repo may decline or cancel service if the situation appears unsafe, unauthorized, fraudulent, unclear, legally risky or outside the scope of service.

If service is canceled, we will communicate the reason and process any applicable refund per the Refund Policy.

Partner Towing Providers

Before Repo may use vetted partner towing providers to perform pickups, transportation and deliveries. Partner providers are required to follow the documentation, conduct and safety expectations described here. Before Repo remains the customer's point of contact and coordinator throughout the case.

Dispute Process

Before initiating any external claim, you agree to first contact Before Repo in good faith to attempt to resolve the issue. Most disputes can be resolved quickly through direct communication and review of the case documentation.

Governing Law

These Terms are governed by the laws of the state in which the service is dispatched. Any dispute that cannot be resolved between the parties will be brought in the courts of that jurisdiction unless otherwise required by applicable law.

Massachusetts Regulatory Compliance

Before Repo operates primarily for borrowers and lenders located in Massachusetts. Before Repo is not a debt collector under 209 CMR 18.00, 940 CMR 7.00, or the federal Fair Debt Collection Practices Act. We do not collect debts on behalf of any creditor.

Before Repo is not a credit counseling agency, credit repair company, debt settlement company, loan modification company or law firm. We do not provide legal advice. Information on the website and in our communications is general and educational only.

Voluntary surrender does not eliminate any deficiency balance you may owe to your lender. You retain all rights under Massachusetts law, including the right to cure under M.G.L. c. 255B, the right to receive proper pre-sale notice, the right of redemption, and the right against breach of peace. You may consult with a Massachusetts-licensed consumer attorney at any time and Before Repo will not impede that right.

Massachusetts General Law Chapter 93A may provide additional consumer protection remedies. Nothing in these Terms waives any non-waivable consumer right under Massachusetts law.

Choice of Law

These Terms are governed by the laws of the Commonwealth of Massachusetts without regard to its conflict of laws principles.

Dispute Resolution

Any dispute, claim or controversy arising out of or relating to these Terms or the services will be resolved in the state or federal courts located in Massachusetts.

The parties may, by mutual written agreement, submit a dispute to binding arbitration administered under the AAA Consumer Arbitration Rules. Any claim arising under Massachusetts General Law Chapter 93A is expressly preserved and is not subject to mandatory arbitration; such claims may be brought in Massachusetts state court.

Changes to These Terms

These Terms may be updated from time to time. The most recent effective date is shown at the top of this page. Continued use of the service after an update means that you accept the updated Terms.
